Creator Terms
Summary
These Creator Terms govern the publication and sale of content on BiblioProf.
BiblioProf means the platform available at biblioprof.ch and operated by the entity identified in the site's legal notice.
By publishing on BiblioProf, you agree to these terms.
1. One BiblioProf account
BiblioProf uses a single member account.
Every registered member may, among other things:
- browse and acquire publications;
- create and publish their own content;
- earn revenue;
- participate in community features offered by the platform.
There is no separate buyer and creator account.
A creator is any member who submits or publishes at least one item of content on BiblioProf.
2. Acceptance of the Creator Terms
You may prepare and save a publication as a draft before accepting these terms.
Acceptance is, however, required before the first submission for which the current terms must be accepted.
Acceptance is:
- personal;
- linked to your account;
- associated with a specific version of these terms;
- recorded with its date and time.
A BiblioProf administrator or team member may prepare a publication on your behalf, but cannot accept the Creator Terms on your behalf.
A new acceptance may be required before a subsequent submission following a material update to these terms.
3. Your publications
You retain the rights you hold in your creations.
By publishing content, you confirm in particular that:
- you have the necessary rights to publish and commercialise it;
- it does not unlawfully infringe third-party rights;
- any texts, images, illustrations, exercises or other materials included may legally be used;
- it does not intentionally contain malware or material intended to compromise BiblioProf or its users.
Publishing on BiblioProf does not transfer ownership of your intellectual property to BiblioProf.
4. Licence granted to BiblioProf
To operate the platform, you grant BiblioProf a non-exclusive licence allowing it, in particular, to:
- store your publication;
- make technical copies required to operate the service;
- display it in the Library;
- generate thumbnails and previews;
- apply watermarks;
- present it on BiblioProf pages;
- make it available for acquisition and delivery to authorised users;
- reference it in search, collections and editorial selections;
- make technical adaptations required for the operation of the service.
This licence does not transfer ownership of your publication.
When a publication is no longer available, BiblioProf may retain information where necessary for legal obligations, accounting, transaction history, backups or dispute resolution.
5. Public previews
You may provide images used to publicly present your publication.
Where the feature is available, you may also ask BiblioProf to generate a preview from one of your PDF files, including from its first page.
BiblioProf may:
- convert the page into an image;
- generate a thumbnail;
- apply a BiblioProf watermark;
- use it as a public preview or gallery image according to your settings.
The original document remains protected under the access rules applying to publication files.
6. Translations
BiblioProf is a multilingual platform operating in particular in French, German, Italian and English.
To make publications accessible in several languages, BiblioProf may provide or generate translations of:
- publication descriptions;
- metadata;
- and, where the feature is available and compatible with the document format, certain publication files.
Translations may be produced automatically, with technical assistance or manually.
You authorise adaptations required for this feature as part of operating BiblioProf.
The original version of your content remains the reference version.
7. Moderation
A publication may be reviewed before or after it becomes available.
BiblioProf may in particular:
- approve a publication;
- request changes;
- reject it;
- temporarily suspend its availability;
- remove it from the Library.
Reasons may include:
- a breach of these terms;
- copyright or third-party rights issues;
- manifestly unlawful content;
- security concerns;
- misleading content;
- incompatibility with the purpose or operation of BiblioProf.
Moderation does not transfer responsibility for the creator's content to BiblioProf.
8. Price and BiblioProf commission
You determine the price of your publication within the rules provided by BiblioProf.
Unless clearly stated otherwise, BiblioProf's standard commission is:
25% of the relevant sale amount.
The remaining amount constitutes the creator's gross earnings, subject in particular to:
- refunds;
- cancellations;
- payment disputes;
- applicable affiliate transactions;
- legitimate accounting adjustments.
Gross volume, commission, earnings and adjustments are recorded separately in BiblioProf's financial system to maintain a traceable financial history.
9. Purchased credit and earnings
BiblioProf distinguishes between:
Purchased credit
Funds purchased by a user to make purchases on BiblioProf.
Purchased credit is not creator income and cannot be withdrawn.
Earnings
Amounts earned by a creator through sales or other mechanisms expressly provided by BiblioProf.
Earnings may be spent on BiblioProf or, once they have become available, requested for withdrawal.
The two balances remain separate.
10. Availability and withdrawal of earnings
Earnings may be subject to a waiting period before becoming available, including to account for potential refunds or corrections.
The applicable period is displayed in your BiblioProf account. At the date of this version, the standard period is 14 days.
A withdrawal request may be made when:
- sufficient available earnings exist;
- the required payment details have been provided;
- the minimum withdrawal threshold has been reached.
At the date of this version, the standard minimum threshold is CHF 50.
These parameters may change for future withdrawal requests. The conditions displayed at the time of the request apply.
11. Bank details
Bank details stored in your account are private and are never displayed publicly.
When a withdrawal is requested, BiblioProf stores a snapshot of the payment information used for that request.
Later changes to your bank details therefore do not retroactively alter an existing withdrawal request.
You are responsible for the accuracy of the information you provide.
12. Refunds, cancellations and payment disputes
If a sale is refunded, cancelled, disputed or corrected, the corresponding financial entries may be reversed or adjusted.
This may affect in particular:
- gross sales volume;
- creator earnings;
- BiblioProf commission;
- applicable affiliate allocations;
- available balance.
BiblioProf maintains a traceable history of these operations.
13. Taxes
Earnings received through BiblioProf may give rise to tax, social security or administrative obligations depending on your circumstances.
Each creator is responsible for identifying and complying with the obligations applicable to them.
BiblioProf does not take over your personal obligations in this respect.
14. Service quality and availability
BiblioProf takes reasonable measures to operate the platform reliably, but does not guarantee:
- any number of sales;
- any level of income;
- any particular placement in the Library;
- any minimum number of views.
Search tools, recommendations, featuring and awards may evolve over time.
15. Account suspension or closure
In the event of serious or repeated breaches of BiblioProf's rules, BiblioProf may in particular:
- restrict certain features;
- suspend new publications;
- remove publications;
- suspend or close an account where justified.
Completed financial transactions remain recorded in accordance with applicable requirements.
Legitimately payable earnings remain handled according to their status and any unresolved disputes.
16. Changes to the Creator Terms
BiblioProf may update these terms to reflect, in particular:
- new features;
- technical developments;
- changes to the business model;
- new legal or regulatory requirements.
Each version is identified.
Where a material change requires renewed acceptance, BiblioProf may prevent a new submission until the relevant version has been accepted.
Draft publications remain accessible.
17. Governing law and contact
These terms are governed by Swiss law, subject to any applicable mandatory provisions.
If a problem arises, we favour direct resolution first.
